Glad you got the damper back.

As someone who worked for a large independent insurance adjusting firm, ALWAYS try to find out if the adjuster is an employee of your insurance company, or if they're an "independent adjuster."

Progressive, Geico, State Farm, etc. do a lot of motorcycle business and likely have people on staff trained to deal with bikes. but if those people are busy, they can and will hire an independent who probably has NO CLUE about bikes. They really may not know what the damper is or does, nor will they know what to value it at. Sometimes that's a good thing, and they'll quote you retail pricing, so you get $700 for the damper you bought used for $400, but it also can mean they're just stupid about certain things.

If I had a dealership and a third party took a part I would need a receipt or talk to the owner.

The problem is with parts from totalled bikes or on an untotalled bike, damaged parts that the insurance company pays a claim on.

Example; Customer demands new fuel tank because of scratch, Insurer agrees to replace tank, adjuster stops by and takes fuel tank, customer then stops by for "his" damaged tank and screams crook when the tank is no longer there.

    Fun all around

Many customers feel that they should both be paid for the damage and then get to keep the parts. I always felt the insurance company owned what they paid for. Not the adjuster, customer or dealer. If the insurer didn't want them, I gave them to the customer.

  5. Difference was here I talked to the insurance company about it and they said that becasue it's an aftermarket plus part, meaning it's not like a part replaced; exhaust, that it's mine and is rightfully so. Talked to the insurance estimator and even in his notes he put the the dampner was mine and that I requested to retain possession of it.

Also I got my part back yesterday. Still going to contact the Better BusinessBbureau and at least report this. Still pissed.
